Abstract:
The Minerals Licencing Round 2018 plan-level HRA was undertaken by The Crown Estate to assess the potential implications on European sites, as required under the Habitats Regulations. The following reports have been produced by GoBe and The Crown Estate and are provided within this series: Screening Report, Report to Inform Appropriate Assessment (RIAA) and Appropriate Assessment.

Having carried out a screening assessment of the plan, The Crown Estate concluded that a likely significant effect (LSE) could not be discounted for a number of European Sites and their qualifying features (GoBe Consultants Ltd, 2020a) [in light of the definition of those terms in the ‘Waddenzee’ ruling of the European Court of Justice Case C – 127/02]. Consequently, an appropriate assessment was required of the implications of the plan for the qualifying features of those sites in view of their conservation objectives. Following the production of a Report to Inform an Appropriate Assessment (RIAA) and the completion of an Appropriate Assessment (“AA”) in accordance with the Regulations, The Crown Estate has ascertained that the plan would not have an adverse effect on the integrity (“AEOI”) of any European Site, either alone or in combination with other plans or projects. Natural England, Natural Resources Wales, the Marine Management Organisation and other selected organisations have been consulted throughout the HRA, and their submissions taken into account by The Crown Estate. This Record of Appropriate Assessment sets out the key issues considered by The Crown Estate and its conclusions in adopting the Minerals Licensing Round 2018 Plan. |
