Abstract:
To support the Marine Licence application, Hywind (Scotland) Limited (HSL) is required to produce a statutory Environmental Statement (ES) under the Marine Works (Environmental Impact Assessment) Regulations 2007 in order to determine whether there is potential for the Project to have any adverse effects on the environment. The ES includes consideration of navigational issues via a Navigational Risk Assessment (NRA) as well as an evaluation of potential impacts on Natura 2000 sites through a Habitats Regulations Appraisal (HRA) assessment. Depending on the findings of the EIA there may also be a requirement for a European Protected Species (EPS) Licence and/or Wildlife Licence. Marine Scotland will confirm this requirement during the ES review. Throughout the EIA process the Design Envelope (previously known as Rochdale Envelope) approach has been used to assess the project design which could result in the greatest potential environmental impacts. Whilst this approach results in a conservative impact assessment; care must be taken to ensure the impacts predicted to arise from the project are not over estimated, such that they are unlikely to ever occur, and therefore undermine the EIA process. This series contains the complete Environmental Statement, including Non-Technical Summary.

| Lineage | Lineage includes the background information, history of the sources of data, data quality statements and methods. | A number of regulatory consents are required for the construction and operation of the Project. For the offshore components of the Project a Marine Licence under the Marine (Scotland) Act 2010 (for Project components within the 12 nm territorial sea limit i.e. the export cable) and the Marine and Coastal Access Act 2009 (for Project components outside 12 nm i.e. the Pilot Park) is required. The offshore application will be submitted to the regulatory authority for the Scottish Government, Marine Scotland. Planning permission for the onshore aspects of the Project will be applied for under the Town and Country Planning (Scotland) Act 1997. The regulatory authority for the onshore application is Aberdeenshire Council. Through screening Aberdeenshire Council has concluded that there is no requirement for an ES under the Environmental Impact Assessment (Scotland) Regulations 1999. Consent under Section 36 of the Electricity Act 1989 is not required for this Project as it is located outside the 12 nm (territorial sea) limit and is below the 50 MW threshold that would trigger such an application. In addition, a Habitats Regulations Appraisal (HRA) has been undertaken to assess potential impacts on conservation sites of European importance and inform the requirement for appropriate assessment.
